
Divorce Mediation is a tested process for couples who have decided to dissolve their marriage. Both spouses meet with a neutral trained divorce mediator to negotiate the terms of their divorce agreement.
No. Divorce Mediation is not a substitute for independent legal advice. Parties should always consult an attorney. Lawyers can help their clients understand the law, make informed decisions, write up the final agreement, and complete the legal divorce procedure. The mediator focuses on helping participants make their own agreement and does not represent either party.
The mediation process may not resolve all issues but even partial agreements can help couples narrow the issues and limit the time and expense of going to court.
All mediators have been approved by Rhode Island Family Court, and most have either a postgraduate degree in mental health or a law degree and have taken specialized training in divorce mediation.
Mediation services are provided by mediators in private practice throughout the state. A skilled mediator ought to have a knowledge of negotiation and mediation techniques, psychology, and family law. A list of professional mediators who practice in the Rhode Island community and who are approved by the Rhode Island Family Court can be obtained from the court.
